Terms & Conditions

1) Eligibility & accounts

You must be at least 13 years old (or the age of digital consent in your region) to use the App. If you open an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account.

2) License & restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App on devices you own or control.

You agree not to (and not to permit others to) modify, reverse engineer (except to the extent such restriction is prohibited by law), decompile, attempt to derive the source code of, or create derivative works of the App or any part thereof; circumvent security features; or use the App for any unlawful, harmful, or abusive purpose.

3) Subscriptions, trials & billing

• Purchases: In-app purchases and subscriptions are processed by Apple App Store or Google Play. We do not collect or store your full payment information.
• Trials: If a free trial is offered, you will be charged at the end of the trial unless canceled at least 24 hours before it ends.
• Renewals & cancellation: Subscriptions renew automatically. You can cancel at any time via your app store account settings; deletion of the App does not cancel a subscription.
• Refunds: Refunds are handled by the platform provider (Apple or Google) according to their policies. We cannot issue refunds directly for purchases made through app stores.
• Price changes: We may change prices for future billing cycles with prior notice as required by law or platform rules.

4) User content & conduct

You may be able to create, upload, or store content in the App (e.g., tasks, notes, settings). You retain ownership of your content. You grant us a limited license to host and process your content to operate and improve the Services.

You are responsible for your content and for complying with applicable laws. Do not post content that is illegal, infringing, or harmful; do not attempt to disrupt or overload the Services; do not misrepresent your identity.

5) Intellectual property

The App and all materials we provide (including software, text, graphics, logos) are protected by intellectual property laws. Except for the license granted above, we and our licensors reserve all rights.

If you provide feedback or suggestions, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use and incorporate them without restriction.

6) Third-party services

The App may include features that rely on third-party services (e.g., analytics, crash reporting, sign-in, cloud sync). Your use of those services is subject to their terms and privacy policies.

7) Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

8) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US (IF ANY) FOR THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

9) Indemnification

You agree to indemnify and hold harmless InControl and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the App.

10) Termination

We may suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms or if we discontinue the App. You may stop using the App at any time. Sections that by their nature should survive termination will survive (e.g., intellectual property, disclaimers, limitation of liability, indemnity, and governing law).

11) Governing law & disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. You and we agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, USA for any dispute not subject to arbitration.

Consumers in the EEA/UK and other regions may have mandatory rights under local law; these Terms do not limit such rights.

Optional arbitration clause: If you later adopt arbitration, replace this section with your arbitration terms and an opt‑out method that complies with your local laws.

12) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice) and update the “Last updated” date above. Your continued use after changes take effect constitutes acceptance.
